1. Who We Are
Moonlight is operated by Oh My Moonlight UG (haftungsbeschränkt), a company registered in Germany. We operate under the brand name “Moonlight” or “Moonlight App.”
Moonlight is a web-based platform designed to support women and underrepresented communities in urban spaces. We connect users with community-verified safety insights and peer support in real time.
These Terms & Conditions govern your use of the Moonlight website and web app. By signing up or using the platform, you agree to be bound by these Terms.
2. Definitions
“Moonlight”, “we”, or “us” refers to the platform operator.
“User” or “you” means anyone who accesses the platform.
“Content” means any data, report, insight, comment, or media you share on Moonlight.
“Platform” refers to both the Moonlight web app and website.
3. Eligibility
Based on German Civil Code (BGB) §305 ff. and Digital Services Act (DSA), we ensure:
Terms are clear and understandable to consumers
Users agree explicitly at registration
Moonlight is not liable as an emergency service (DSA Article 5)
4. Acceptable Use
Content moderation complies with:
DSA Article 16 (Notice and Action procedures)
German NetzDG (for illegal content) if ever applicable
BGB §241(2) – users must respect the rights and interests of others
5. Intellectual Property
You grant us a license to use your submitted data in a non-commercial, anonymized form under:
BGB §§ 31–33 (usage rights)
All original content by Moonlight is protected by Urhebergesetz (UrhG – German Copyright Law)
7. Liability
Limitations based on:
BGB §276–278 – limits liability to intent and gross negligence
DSA Article 7 – exemption from liability for user-generated content, with timely takedown procedures
8. Governing Law
This agreement is governed by:
The laws of the Federal Republic of Germany, particularly the BGB
Jurisdiction: Berlin, unless otherwise mandated by EU consumer law
